Terms of Service
These Terms of Service (“Terms”) govern your use of WS Blaster (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is operated by WS Blaster, registered in Malaysia, with its registered office at Kuala Lumpur, Malaysia.
1. Eligibility
You must be at least 18 years old and legally able to enter into a contract in your jurisdiction to use the Service. If you use the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.
2. The Service
WS Blaster helps you send WhatsApp messages through Meta’s official WhatsApp Cloud API using your own connected WhatsApp Business account. We provide tools to manage your connection, audiences, message templates, and campaign delivery.
During the early-access period, the Service is provided free of charge. We may introduce paid plans in the future; if we do, we will notify you in advance and these Terms will be updated accordingly.
3. Acceptable use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and platform policies. In particular, you agree that you will:
- Only send messages to recipients who have opted in or who have had a prior business interaction with you, as required by WhatsApp Business Policy.
- Never use the Service to send spam, unsolicited messages, deceptive content, or content that violates the rights of others.
- Only upload contact data that you have collected lawfully and that you are entitled to use.
- Keep your account credentials and Meta access tokens secure.
4. Meta and WhatsApp policy compliance
You must at all times comply with:
- The WhatsApp Business Messaging Policy.
- The WhatsApp Commerce Policy.
- The Meta Platform Terms.
- All other policies Meta publishes for use of the WhatsApp Cloud API.
Misuse of the Service may result in message restrictions, suspension, or permanent termination of your account, and may also be reported to Meta. WS Blaster is not responsible for actions Meta takes on your WhatsApp Business account, including quality-rating downgrades, sending-limit reductions, or account bans.
5. Account security
You are responsible for safeguarding your account credentials and any API tokens issued to you. Notify us promptly at hello@ws-blaster.com if you suspect unauthorized access.
6. Your content
You retain all rights to the audience data, message templates, and campaign content you upload (“Your Content”). You grant WS Blaster a limited license to host, process, transmit, and display Your Content solely as necessary to operate the Service on your behalf.
You represent that you have all rights and consents required to upload and use Your Content, including any consents required under applicable data-protection laws and under WhatsApp Business Policy.
7. Third-party services
The Service depends on Meta’s WhatsApp Cloud API and on other third-party providers (hosting, email, monitoring). WS Blaster is not responsible for the availability, accuracy, or conduct of these third-party services. Your use of WhatsApp is also governed by WhatsApp’s own terms and policies.
8. Payments and refunds
During the early-access period, the Service is provided at no charge.
If we introduce paid plans in the future:
- Fees will be disclosed on the plan page before you subscribe.
- Subscription fees are generally non-refundable once a paid period has started.
- We will not issue refunds for issues caused by Meta (quality-rating downgrade, template rejection, sending-limit reduction, account ban) or by incorrect configuration of your own WhatsApp Business account.
- Refund requests must include your account email, the affected phone number, a clear description of the issue, and supporting evidence, and must be submitted within 14 days of the charge.
9. Suspension and termination
We may suspend or terminate your access to the Service if you breach these Terms, if your Meta account is restricted or banned, if continued service would create a security or legal risk, or if the early-access program ends. You may stop using the Service at any time and request deletion of your account data.
10. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
11. Limitation of liability
To the maximum extent permitted by law, WS Blaster and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 100.
12. Indemnification
You agree to indemnify and hold WS Blaster and its operators harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your use of the Service, Your Content, or your breach of these Terms.
13. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. Material changes will be notified to you through the Service or by email where appropriate. Continued use of the Service after a change constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of Malaysia, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of Malaysia, unless applicable consumer law in your jurisdiction gives you the right to bring proceedings in your local courts.
